General Terms and Conditions of Sale
These General Terms and Conditions of Sale govern the contractual relationship between:
- Zwei French in Berlin, organizer of scavenger hunts in the city of Berlin.
- The Customer (or Player), a natural or legal person wishing to benefit, for themselves or for third parties, from the services offered.
- The Participant(s), natural or legal person(s) taking part in the services organized by the organizer.
Booking and participation in the services organized by Zwei French in Berlin imply unconditional acceptance of these General Terms and Conditions of Sale as set out in this document. These terms take precedence over any other terms not recognized by Zwei French in Berlin.
Zwei French in Berlin reserves the right to amend its terms at any time. In such cases, the terms in force at the time of booking or at the time of signing the offer shall apply.
Article 1: The Organizer.
Zwei French in Berlin, a GbR with share capital of xxx €, with its registered office at Achtrutenberg 24, 13125 Berlin, organizes scavenger hunts across Berlin during its opening hours.
Article 2: Principle of the game.
On the day of the booking of the service, the Player must independently go to the starting point. This information is provided at the time of booking. Delays will not be tolerated.
At the meeting point, the equipment is lent to the Player who made the booking. This equipment, adapted to the respective game, enables the Players to follow the thread of their investigation independently. Along their way through the city, there are many puzzles to solve. These puzzles are related to the proposed scenario. By observation and a sense of deduction, the Players can progress.
A hint system is integrated into the borrowed equipment, which enables the Player(s) to make progress without asking for outside assistance.
The Players have 3 hours to complete the scenario “The Nefertiti Affair”.
The game is available in 3 languages: German, English and French.
Article 3: Conditions for participation.
The services of Zwei French in Berlin are open to natural persons of legal age. For minors, the services are accessible under the responsibility of their guardian or legal representative.
Further information on the participation of minors can be found in the additional notes at the end of this document.
Article 4: Registration.
The Player who wishes to register may do so via our website
Zwei French in Berlin offers operating days and hours. The Participant can therefore book their session on the days and at the times offered via our online booking system.
The Player guarantees the accuracy of the information provided during the booking process.
However, we recommend an ideal number of 2 to 6 players for the scenario “The Nefertiti Affair”.
The Player validates their booking, which becomes effective upon online payment via a secure payment platform.
The Player may exercise their right to have their personal data deleted. This right can be exercised online by sending an email to contact@outscapeberlin.de
By clicking on Book, the Applicant accepts these General Terms and Conditions of Sale.
After confirmation of payment, the Applicant receives their reservation ticket, which must be presented on the day of the session. The Player may present this ticket either printed or in digital form.
Zwei French in Berlin reserves the right to require the Applicant to present an identity document on the day of the session and to retain it as a deposit during the session. You can reach our customer service by email at the following address: contact@outscapeberlin.de
Article 5: Payment.
Payment is made online by credit card via a secure payment platform.
Prices are indicated inclusive of all taxes.
Zwei French in Berlin reserves the right to change its prices at any time. However, the service will be charged on the basis of the rate in force at the time of booking.
Payment data are not stored by Zwei French in Berlin.
Article 5a: Conformity.
The Applicant must ensure the conformity of their reservation ticket. Complaints must be made within 24 hours after the booking. No complaint will be accepted after the service.
The Applicant must ensure that the ticket has been received by email and inform Zwei French in Berlin if this is not the case. Zwei French in Berlin shall not be liable if the Applicant is unable to make use of the service without Zwei French in Berlin having previously been informed that the Applicant had not received something.
Article 6: Cancellation.
The Applicant undertakes to inform Zwei French in Berlin of a cancellation. No refund will be made if the cancellation request is submitted within 24 hours before the start of the game.
No refunds are granted after the start of the game.
In the event of a cancellation by the Organizer due to an important event that prevents the performance of the service and is not attributable to Zwei French in Berlin, the event will be canceled or postponed, without the Participant being able to derive any claims therefrom.
The Organizer will endeavor to notify the Applicant, in the event of a cancellation, before the start of the game. The Applicant may then be contacted by email or by telephone if a valid number has been provided. The Applicant agrees that Zwei French in Berlin may use the contact details provided at the time of booking to contact the Applicant.
Article 7: Refund.
There is no entitlement to a refund for services that are interrupted, shortened, or not used by the Participant, for whatever reason. In the event of loss of the ticket or failure to present the ticket on the day of the event, no refund will be made. Late arrival or non-appearance is deemed a withdrawal and does not result in a refund.
Article 8: Weather conditions.
Zwei French in Berlin provides the participant(s) with a rain cover (poncho, umbrella) in the event of rain. In particularly adverse weather conditions, thunderstorms, flooding, or storm, the session may be postponed, canceled, and refunded.
If, during the session, weather conditions make it impossible to continue the game, the session may be postponed, terminated, and refunded, provided that the playing time of 1 hour 30 minutes has not been exceeded.
Article 9: Disputes and responsibilities.
Zwei French in Berlin is not liable for accidents, injuries, or damage caused by the Participant during the event. Each Participant is responsible for their actions. The Organizer can be contacted at any time during the game via a telephone number that has been communicated to the Player(s) before the start.
The equipment provided is the property of Zwei French in Berlin and must be returned in full at the end of the game. Should this not be the case, Zwei French in Berlin will not hesitate to contact the competent authorities.
Participation in the games of Zwei French in Berlin implies full acknowledgment of these rules.
Article 10: Delegation of powers.
The parties agree that this contract is governed by German law.
In the event of a dispute, the parties will endeavor to reach an amicable settlement. For all disputes that cannot be settled amicably, the competent courts shall have jurisdiction.
Article 11: Data processing and data protection.
Zwei French in Berlin undertakes to ensure the security and protection of data, in particular that such data are not disclosed to third parties.
Article 12: Intellectual and artistic property.
The materials, the scavenger hunts and their puzzles are the property and creation of Zwei French in Berlin. In this sense, the presentation and the distribution of any elements that constitute this game, in particular the puzzles, is strictly prohibited under threat of legal action.
Any dissemination of images or videos relating to the content of the scavenger hunt on social networks is strictly prohibited.
Article 12a: Protection of intellectual property and prohibition of recordin
The games, scenarios, puzzles and materials developed by Zwei French in Berlin, as well as their sequence and presentation, constitute works protected within the meaning of Sections 2(1) Nos. 1, 4 and 7 of the German Copyright Act (UrhG). The company expressly reserves all rights in these contents.
Any reproduction, distribution, making available to the public or other use of the game contents, in particular by photographing, filming, audio or video recordings during the game as well as their dissemination via social networks, websites or video platforms (e.g. YouTube, Instagram, TikTok), is strictly prohibited without the prior express written consent of Zwei French in Berlin (Sections 15, 19a UrhG).
Violations constitute an infringement of intellectual property rights and may be prosecuted under civil and criminal law (Sections 97 et seq. UrhG). This also applies to the publication of solutions, hints or the complete game structure that is capable of impairing the value of the game for future participants.
Zwei French in Berlin reserves the right to assert claims for injunctive relief and damages in the event of violations.
Article 13: Image rights.
The Participants tacitly agree to transfer their image rights in the context of reporting, filming or film recordings during the game.
If the Participant does not wish to transfer their image rights, they must submit a request either by e-mail to contact@outscapeberlin.de or by means of a written document, which must be sent before the start of the game.
Article 14: Private sessions and quotation requests.
It is possible for third parties to reserve services for a private session. A quotation request form must be completed at the following address on our website (https://outscapeberlin.de/de/kontaktieren-sie-uns/
It is the responsibility of the Applicant to verify the conformity of the information in the Organizer’s offer. Any complaint must be made within 24 hours of receipt of the offer. After the service has been performed, no complaint will be accepted.
If the Customer wishes an invoice, they must request it before the start of the game (ideally 72 hours before the event).
The request to change the delivery of an accepted quotation must be sent by e-mail to the following address : contact@outscapeberlin.de.
A request for modification may be made up to 72 hours before the start of the game.
The Organizer may refuse the request for modification at any time and without stating reasons.
If there is no written acceptance of the request by the Organizer within 8 days of receipt of the request, the terms of the original offer shall apply. In this case, no compensation may be claimed from the Organizer.
In the case of private sessions, the Participants unreservedly accept the General Terms and Conditions of Sale set out in Articles 1 to 13.
Article 15: Severability clause.
Should any provisions of these General Terms and Conditions be or become invalid, in whole or in part, the validity of the remaining provisions shall not be affected.
Article 16: Additional information and clarifications.
- Minors aged 14 and over may participate in the game, provided that written consent of the legal guardian is presented.
- Participants undertake, during the game in public space, to observe the applicable traffic rules, environmental regulations, as well as respectful conduct toward passers-by and urban infrastructure.
- The loaned game material remains the property of Zwei French in Berlin and must be handled with care. In the event of loss or willful damage, Zwei French in Berlin reserves the right to assert claims for compensation.
- Booking is only possible if the customer expressly declares, by ticking the corresponding checkbox, that they have read and agree to the General Terms and Conditions of Sale.
